These Terms of Service apply to vanilloleads.com and to the services provided by VanilloLeads, a trade name of Matthew D. Villano Jr., Doylestown, Pennsylvania ("VanilloLeads," "Company," "we," "us," or "our"). By accessing or using our website or services, you agree to these Terms of Service, our Privacy Policy, and any additional terms that apply to a specific service.

SMS Messaging Terms and Compliance

• Program description. This messaging program sends replies to inquiries, appointment confirmations and reminders, customer support messages, and promotional messages about our AI receptionist service, such as offers, information, and follow-ups. Messages go only to people who have opted in by entering their mobile number in the chat widget on our website and checking the consent box. Promotional messages are sent only to people who have explicitly consented to receive them.
• Cancellation. You can cancel the SMS service at any time. Text STOP to the number that sent you messages. We will confirm your unsubscribe by text, and after that you will receive no further messages from us. To rejoin, opt in again through the chat widget.
• Support. If you have a problem with the messaging program, reply HELP, email matt@vanilloleads.com, or call (267) 314-6182.
• Carrier liability. Carriers are not liable for delayed or undelivered messages.
• Message and data rates. Message and data rates may apply to messages sent to you and by you. Message frequency varies with your inquiry, any appointment you arrange, and the promotional messages you agreed to receive. For questions about your plan, contact your wireless provider.
• Supported carriers. The program works with all major U.S. wireless carriers, including AT&T, T-Mobile, Verizon, and most regional carriers.
• Age restriction. You must be 18 years or older to participate in our SMS program.
• Privacy. For privacy questions, see our Privacy Policy. We do not sell, rent, or share mobile phone numbers or text messaging consent with third parties or affiliates for marketing or promotional purposes.
• Consent. Consent to receive text messages is not a condition of purchase or of using our services.

We comply with applicable laws and industry guidelines for text messaging, including the Telephone Consumer Protection Act (TCPA) and CTIA guidelines. See also our SMS Terms.

General Terms

We may change these Terms of Service from time to time. We will post the revised terms on this website with a new effective date, and by continuing to use our website or services after a change you accept the terms as modified.

Services

VanilloLeads provides an AI voice receptionist service for home service businesses such as plumbers, including answering calls, booking appointments, and related text messaging and reporting. The specific scope of services, fees, and any service commitments are set out in an individual written agreement with each client. Nothing on this website is an offer or a guarantee of results.

Your responsibilities

You agree to give accurate and complete information when you use our services or submit information through our website, and to keep any account credentials confidential. You are responsible for activity under your account.

Payment terms

Payment terms are specified in each client's service agreement. Unless the agreement says otherwise, invoices are due on receipt, and late payments may carry additional fees as set out in the agreement.

Intellectual property

The content of this website, and materials, designs, and configurations we create, remain our property until full payment is received. On full payment, ownership of deliverables passes to the client as stated in the service agreement. You may not copy, republish, sell, create derivative works from, or distribute material from this website without our permission.

Disclaimers

The information and services on or through this website are provided "as is," without warranties of any kind, express or implied, to the fullest extent the law allows, including implied warranties of merchantability and fitness for a particular purpose. You agree to indemnify and hold harmless VanilloLeads and its owner, agents, and employees from claims, damages, liabilities, and expenses arising out of your breach of these terms.

Limitation of liability

We are not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability is limited to the amount you paid for the specific service that gave rise to the claim.

Termination

Either party may end services as set out in the individual service agreement, and you remain responsible for payment for services already provided. We may suspend or end your access to our website without notice if we determine you have violated these terms.

Third-party links

Our website may link to third-party sites. We are not responsible for their content, privacy practices, or terms.

Governing law

These terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law rules.
